Terms of Service

These terms of service, together with any other agreements or terms incorporated by reference, including the Privacy Policy (the "Terms"), govern your use of the Services. These Terms constitute a binding and enforceable legal contract between Zerf LLC, doing business as Wander Scrapbooks ("Company") and You. By using the Services, you agree to these Terms.

1. Definitions

  • "Content" means any files, data, material, and information submitted, uploaded, and stored by You through the Service, including but not limited to traveler names, destination details, travel dates, companion information, dedications, custom quotes, and any other personalization inputs.
  • "Journal" means an AI-personalized, printed travel journal created through the Platform based on Your Content and personalization inputs.
  • "Platform" means Company's online solution for purchasing personalized AI-generated printed travel journals.
  • "Services" means any applications, products, services, documentation, and software made available through the Platform.
  • "Third Party Services" means any service provided by a third party that interoperates with the Services, including Lulu Press, Inc., Stripe, and Klaviyo.
  • "User Data" means data relating to Your use of the Platform and Services, including contact and payment information, usage data, personalization inputs, and settings.

2. The Services

We may update the Services from time to time, including adding or removing functions.

Use of Data

Company may collect User Data, and You hereby grant Company permission to use such User Data to improve the Platform's performance and functionality, enhance services and support, and for other business purposes including monitoring, diagnostics, and billing.

AI-Generated Content

Some features of the Platform utilize artificial intelligence to generate personalized journal content, including welcome letters, daily prompts, travel recommendations, fun facts, and cover illustrations. You agree that Company uses third-party AI providers to enable these features.

Company does not permit third-party AI providers to use your data to train or improve their foundation models.

You are solely responsible for the legality, accuracy, and quality of your inputs. You acknowledge that: (i) the Company is not responsible for the accuracy of AI-generated output; (ii) output depends on the data you provide; and (iii) other customers with similar inputs may receive similar content.

Print Fulfillment

Journals are manufactured and shipped by Lulu Press, Inc. Company coordinates the production process but does not directly manufacture the physical product.

3. Your Content

License to Content

You grant us a worldwide, non-exclusive license to host, copy, process, and use your Content as required to provide the Services. Subject to this limited license, we do not acquire any right in your Content.

You warrant that You have full rights to provide any Content through the Services, including information of third parties such as gift recipients and travel companions.

Responsibility for Content

The Services are not intended to be used as storage, backup, or archiving services. You are responsible for backing up your Content and for any lost or unrecoverable Content.

4. Copyright Policy

We respect intellectual property rights. In accordance with the DMCA, we have adopted a policy of restricting access to or deleting infringing content. If you believe something on the Services infringes your copyright, please contact us at hello@wanderscrapbooks.com with the required information under 17 USC 512(c).

5. Fees and Payment

You authorize Company or its payment processors to charge your selected payment method for all fees. Fees are non-refundable except as outlined in our Return Policy.

You are responsible for providing complete and accurate billing information. Payment processing is handled by Stripe, Inc. Our fees do not include taxes, which will be charged if required.

6. Use Obligations and Restrictions

You agree to:

  • Comply with all applicable laws and regulations.
  • Pay fees when due.
  • Provide accurate information during the customization process.
  • Ensure that personal information of third parties is provided with appropriate consent.

You must not:

  • Sell, resell, or lease the Services.
  • Circumvent any access or use restrictions.
  • Use the Services to store or transmit unlawful, infringing, or harmful content.
  • Attempt to disable or impair the Services.
  • Reverse engineer or decompile the Services.
  • Attempt to manipulate the AI features to generate content that violates these Terms.

7. Intellectual Property Rights

All rights not expressly granted to You are reserved by Company. Upon completion of payment and fulfillment, You receive ownership of the physical printed Journal. Company retains all rights to underlying templates, designs, AI-generated content frameworks, and platform technology.

8. Indemnification

You will indemnify and hold harmless Company from all liabilities, damages, and costs arising out of claims that your Content or use of the Services infringes third-party rights or violates applicable law.

9. Disclaimers of Warranties

The Services are provided on an "as is" and "as available" basis. Company disclaims all warranties of any kind, express, implied, or statutory. Company does not warrant the accuracy of AI-generated content, including travel recommendations and destination-specific information. Such content is provided for entertainment and general informational purposes only.

10. Limitation of Liability

In no event will Company be liable for incidental, special, indirect, or consequential damages, or loss of profits, revenue, data, or goodwill. Company's total liability will not exceed the greater of US $100.00 or the fees paid by You in the 12 months preceding the claim.

11. Term and Termination

These Terms commence when you first accept them and remain in effect until terminated. You may stop using the Services at any time. We may suspend or terminate your access at our discretion if You do not comply with these Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, and the courts in Florida will have jurisdiction.

13. General

Shipping and Delivery

We use Lulu Press, Inc. for manufacturing and shipping. Delivery times may vary based on your location and selected shipping method. Estimated delivery times are not guaranteed.

Returns and Refunds

As our Journals are custom-made and personalized, we do not accept returns unless the product is defective or damaged upon arrival. See our Return Policy for details.

Changes to Terms

Company may change these Terms from time to time. By continuing to use the Services, you agree to be bound by the revised Terms.
